Right of Withdrawal
Important Notice: This English version of the right of withdrawal is provided for convenience only. In the event of any discrepancies, inconsistencies, or conflicts, the German version shall prevail and is legally binding.
The right of withdrawal for the purchase of precious metals is excluded pursuant to Section 312g (2) No. 8 of the German Civil Code (BGB).
- Contracts for the supply of goods or services, including financial services, whose price depends on fluctuations in the financial market over which the trader has no control and which may occur within the withdrawal period – in particular: the right of withdrawal does not apply, unless otherwise agreed by the parties, to the following contracts.
- Services related to shares, units in open-ended investment funds within the meaning of Section 1 (4) of the German Capital Investment Code (KAGB), and other tradable securities, foreign exchange, derivatives, or money market instruments.
This statutory provision is intended to protect precious metals dealers from speculative transactions. For example, if the price of precious metals decreases after an order has been placed and the buyer were to exercise a right of withdrawal, the trader would bear the financial loss.
Such speculative behavior would not only negatively affect the trader but also all customers, as these additional costs would ultimately have to be passed on.
For this reason, withdrawal is generally not possible. Orders are therefore binding.

Consumers are entitled to a right of withdrawal for contracts for the supply of goods in accordance with the following provisions.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
Withdrawal Instruction
Insofar as the contract concerns the supply of goods whose price is subject to fluctuations in the financial market, over which the trader has no influence and which may occur within the withdrawal period, there is no right of withdrawal pursuant to Section 312g (2) No. 8 of the German Civil Code (BGB).
If the purchased item does not constitute goods within the meaning of Section 312g (2) No. 8 BGB, the customer shall be informed of the right of withdrawal as follows:
Right of Withdrawal
You have the right to withdraw from this contract within fourteen (14) days without giving any reason.
The withdrawal period is fourteen (14) days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the last goods.
To exercise your right of withdrawal, you must inform us (Orafino GmbH, Steigestr. 64, 69412 Eberbach, Germany, Phone: +49 62718039672, Email: info@orafino.de) by means of a clear statement (e.g., a letter or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen (14) days from the day on which we receive notification of your withdrawal. We will use the same means of payment that you used for the initial transaction, unless expressly agreed otherwise; in no event will you be charged any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs first.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen (14) days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen (14) days has expired. We will bear the cost of returning the goods.
You are only liable for any diminished value of the goods if this is due to handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
Exclusion or Early Expiry of the Right of Withdrawal
The right of withdrawal does not apply to contracts for the supply of goods whose price is subject to fluctuations in the financial market which cannot be controlled by the trader and which may occur within the withdrawal period.
The right of withdrawal does not apply to consumers who, at the time of contract conclusion, are not members of a Member State of the European Union and whose sole residence and delivery address are located outside the European Union.
